Welcome to Turn Mystr. These Terms of Service ("Terms") govern your use of our platform, website, and services (collectively, the "Service"). By accessing or using Turn Mystr, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Turn Mystr, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice on our website or sending you an email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

Turn Mystr is a platform that connects property hosts ("Hosts") with cleaning service providers ("Cleaners") for short-term rental turnover services. Our Service includes:

• Property management tools for Hosts
• Cleaning job scheduling and management
• Communication tools between Hosts and Cleaners
• Payment processing for cleaning services
• Calendar integration with rental platforms

3. User Accounts

3.1 Account Registration

To use Turn Mystr, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Types

Turn Mystr offers two types of accounts:

• Host Account: For property managers who need cleaning services
• Cleaner Account: For individuals or businesses providing cleaning services

4. Host Responsibilities

As a Host, you agree to:

• Provide accurate property information and cleaning requirements
• Pay Cleaners promptly for completed services
• Communicate clearly about expectations and any special instructions
• Maintain safe and accessible properties for Cleaners
• Comply with all applicable laws regarding property rental and employment

5. Cleaner Responsibilities

As a Cleaner, you agree to:

• Provide cleaning services professionally and to the agreed-upon standards
• Arrive on time for scheduled cleanings
• Communicate promptly about any issues or schedule changes
• Maintain appropriate insurance coverage for your services
• Comply with all applicable laws regarding independent contractor status and taxes

6. Independent Contractor Relationship

Cleaners using Turn Mystr are independent contractors, not employees of Turn Mystr or Hosts. Cleaners are solely responsible for:

• Their own taxes, including self-employment taxes
• Obtaining necessary business licenses and permits
• Maintaining appropriate liability insurance
• Providing their own cleaning supplies and equipment unless otherwise agreed

7. Payments and Fees

7.1 Service Fees

Turn Mystr charges subscription fees to Hosts for access to the platform. Current pricing is available on our pricing page. We reserve the right to modify our fees with 30 days' notice.

7.2 Payment Processing

Payments between Hosts and Cleaners are processed through Stripe, our third-party payment processor. By using our payment features, you agree to Stripe's terms of service. Processing fees may apply.

7.3 Cleaner Payments

Hosts agree to pay Cleaners the agreed-upon amount for completed services. Payments are processed through our platform and transferred to Cleaners' connected bank accounts.

8. Cancellations and Refunds

Cancellation policies for cleaning jobs are established between Hosts and Cleaners. Turn Mystr is not responsible for disputes regarding cancellations. Subscription refunds are handled on a case-by-case basis.

9. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Circumvent our payment system to avoid fees
• Harass, abuse, or harm other users
• Provide false or misleading information
• Interfere with the proper functioning of the Service
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the Service without permission

10. Intellectual Property

Turn Mystr and its content, features, and functionality are owned by Turn Mystr and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

11. Privacy

Your use of Turn Mystr is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Turn Mystr does not guarantee the quality, safety, or legality of cleaning services provided by Cleaners. Hosts are responsible for vetting Cleaners and Cleaners are responsible for the quality of their work.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURN MYSTR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to Turn Mystr in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Turn Mystr, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

15. Dispute Resolution

Any disputes arising from these Terms or your use of Turn Mystr shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You agree to waive your right to a jury trial and to participate in class action lawsuits.

16. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
